These General Terms and Conditions (GTC) apply to all business relationships between Kuckein Consulting – Kai Kuckein, Lutherstr. 9, 65203 Wiesbaden, Germany (hereinafter "Provider") and the customer. Deviating GTC of the customer shall not be recognized unless the Provider expressly agrees to their validity in writing.
The Provider is developing the macOS application "OnWhispr" for local speech-to-text processing. The application is currently in private beta. Distribution and final commercial terms will be announced before public launch.
The contract is concluded by purchasing the software via the Mac App Store. Apple's terms of use also apply.
Joining the waitlist is free and does not create a purchase contract. Pricing and payment terms for a later full version will be announced transparently before public launch. If distributed through the Mac App Store, payment will be processed by Apple.
OnWhispr processes all data exclusively locally on the customer's device. No voice or text data is transmitted to servers. The software requires no internet connection after the initial download of AI models.
Statutory warranty rights apply. The Provider warrants that the software is free from material and legal defects at the time of delivery. The warranty period is two years from the date of purchase.
The Provider is liable without limitation for intent and gross negligence. For slight negligence, the Provider is only liable for breach of material contractual obligations. In this case, liability is limited to the foreseeable, typically occurring damage. Liability for damages arising from injury to life, body or health remains unaffected.
The law of the Federal Republic of Germany applies. The place of jurisdiction, insofar as legally permissible, is Wiesbaden. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
